To: Constable of the Town of Ashby in said County:

Greeting:

In the name of the Commonwealth, you are hereby directed to notify and warn the inhabitants of the Town of Ashby, qualified to vote in elections and town affairs, to meet at the Elementary School Auditorium in said Ashby, Saturday, May 6, 2000 at 9:30 a.m. to act on the following articles:

SPECIAL TOWN MEETING ARTICLES

 

Article 1. To see if the Town will vote to appropriate from available funds the sum of $117,165.40 from Chapter 90 funds from the Commonwealth to be used by the Highway Department in accordance with the General Laws, or take any action thereon.

Article 2. To see if the Town will vote to appropriate the sum of $26,000 from Free Cash for the purpose of paying legal services fees, or take any action thereon.

Article 3. To see if the Town will vote to transfer the sum of $6,000 from the Town Office Clerical account, $4,000 from the Veterans Benefits account and $4,000 from Town Common Repairs for the purpose of paying an architect, engineer and grant writer to assist the Town in preparing grants to fund the rehabilitation of the Lyman Building, or take any action thereon.

Article 4. To see if the Town will vote to transfer the sum of $900 from the Council on Aging expense account for the purpose of purchasing backfill to support the stone wall at the Miller’s Garage site, or take any action thereon.

Article 5. To see if the Town will vote to transfer the sum of $4,040.86 from the Fire Water Hole account and $1,959.14 from the Police Officer Salary account for the purpose of paying police expenses, or take any action thereon.

Article 6. To see if the Town will vote to transfer the sum of $400 from Town Common Repairs account and $557.78 from the Hazardous Waste account to the Conservation Fund pursuant to G.L. c. 40, Sec. 8C, or take any action thereon.

Article 7. To see if the Town will vote to authorize the Selectmen to acquire by purchase, eminent domain or otherwise as provided by the General Laws, a portion of the property known as the Lyman Fields consisting of approximately 12.5 acres more or less, being a portion of the parcel shown on Assessor’s Map 10, Parcel 24, being the same land shown on a plan entitled "Plan of Land of Klaus & Andrea S. Kater" by Szoc Surveyors dated April 11, 2000, a copy of which is available in the Town Clerk’s office, and to transfer the sum of $98,000 from the Landfill Escrow Account subject to the approval of Massachusetts Department of Environmental Protection, to cover any and all costs associated with this land acquisition and proceedings hereby authorized, for cemetery purposes and to protect open space, or take any action thereon.

Article 8. To see if the Town will vote to authorize the Selectmen to acquire by purchase, eminent domain or otherwise as provided by the General Laws on such terms and conditions as are in the Town’s best interest certain parcels of land located on Mt. Watatic being the parcels shown on Assessor’s Map 1, Parcel 2 and further being the same land shown on a plan entitled "Compiled Plan of Land Located in Ashby and Ashburnham, Massachusetts owned by David J. Fenton Jr., Trustee of the "Mt. Watatic Nominee Trust’" by Hub Survey Associates, Inc. dated March 9, 2000 consisting of approximately 231 acres in Ashby for the protection of open space, and further authorizing the Selectmen to grant such easements as may be appropriate for access by the owner thereof to remaining land in the Town of Ashburnham, said acquisition and all costs associated therewith to be paid for by gifts and/or grant to the Town for such acquisition, or take any action thereon.

Article 9. To see if the Town will vote to transfer the sum of $1,640.86 from the County Retirement account, $1,800 from Group Insurance account, $400 from Town Common Repairs account, $1,870.87 from the Millennium Event account, $100 from the Earth Removal Board Expenses account and $3,500 from the Temporary Loan Interest account to the Reserve Fund account for the purpose of replenishing the fund for unforeseen expenditures, or take any action thereon.

And you are hereby directed to serve this warrant by posting an attested copy in at least three (3) public places in said Ashby fourteen (14) days at least before holding of said meeting. Hereof, fail not, and make due return of this warrant with your doings thereon, to the Town Clerk at the time and place of meeting aforesaid.
