RESULTS OF THE SPECIAL TOWN MEETING March 10, 1999

The warrant was returned to the Assistant Town Clerk at 7:00 PM by Constable John H. Brodie.

The Moderator was not present. The Assistant Town Clerk announced a quorum was present and called the meeting to order. The return of the warrant showed it was properly served. The Assistant Town Clerk accepted nominations from the floor for the position of Temporary Moderator.

A motion was made and seconded to nominate Karen Wheeler.

A motion was made and seconded to close nominations.

VOTE: UNANIMOUS

A motion was made and seconded that the Assistant Town Clerk cast one ballot for Karen Wheeler.

VOTE: UNANIMOUS

The Assistant Town Clerk declares Karen Wheeler Temporary Moderator. Karen was sworn in as Temporary Moderator.

The rules of the meeting were read by the moderator.

Article 1. The motion was made and seconded to approve the $2.5 million debt authorized by a vote of the North Middlesex Regional District School Committee on January 11, 1999 to incur such debt for financing the costs of designing, engineering and constructing (1) a new roof for the North Middlesex Regional High School, including costs incidental and related thereto; (2) window replacement at the old gymnasium; and (3) HVAC upgrade work; and further to raise and appropriate by borrowing $449,050’ which constitutes Ashby’s share for said costs, provided that no debt shall be incurred and no funds voted hereunder shall be expended unless and until the Town of Ashby shall vote to exempt such debt from the provisions of Proposition 2 1/2, so called, and provided further that a failure to achieve approval of a debt exclusion on a ballot under the provisions of Proposition 2 1/2, so called, shall be and is hereby deemed a disapproval by the Town of the district’s vote to incur such debt, and provided further that no funds shall be expended hereunder unless and until the other member towns have also voted to appropriate the proportional share for this purpose.

Article 2. The motion was made and seconded to amend Article 11, Section 2 of the General by-laws by striking therefrom in its entirety the single sentence appearing therein, and inserting in place thereof the following sentence, namely: The Annual Town Election shall be held on the fourth Monday of April each year. The polls shall be open from 7:00 a.m. and close at 8:00 p.m. every third year, starting April 1999 to coincide with At-Large School District-Wide elections. The other two years the polls shall be open from 12:00 noon and shall close at 7:30 p.m. and

to delete Section 3 in its entirely, and

to renumber the remaining Sections 4 - 19, as 3 - 18, of Article 11 to reflect the absence of Section 3.

VOTE: MOTION PASSED

Article 3. The motion was made and seconded to transfer the sum of $800 from Town Accountant Clerical #01-5-135-003 to Town Accountant Salary #01-5-135-000 for the purpose of compensating the Town Accountant.

Article 4. The motion was made and seconded to amend Zoning Map to change the existing Residential/Commercial district along Fitchburg State Road to Residential/Commercial District A and to change the Residential/Commercial district along Main Street as Residential/Commercial District B, and to make certain changes to the Zoning Bylaw as follows:

to section 6.1 add the words "in all residential/commercial districts" following the words" permitted uses", and to section 6.2 add the words "in all residential/commercial districts," following the words "special permits" and

to create sections "6.4 Residential/Commercial District A" and "6.4..1 Permitted Uses" and "6.4.2 Special Permits: Uses which may be allowed by the Board of Appeals after a public hearing and subject to appropriate regulations, if determined to be neither offensive nor detrimental to the residential/commercial area", and

to create sections "6.5 Residential/Commercial District B" and "6.5.1 Permitted Uses" and "6.5.2 Special Permits: Uses which may be allowed by the Board of Appeals after a public hearing and subject to appropriate regulations, if determined to be neither offensive nor detrimental to the residential/commercial area" and

to renumber the following sections and move each section to consecutive placement in newly created section 6.4; (1) existing section 6.14 shall be renumbered to 6.4.1.1; (2) existing section 6.205 shall be renumbered 6.4.2.1; (3) existing section 6.209 shall be renumbered to 6.4.2.2; (4) existing section 6.212 shall be renumbered to 6.4.2.3; (5) existing section 6.208 shall be renumbered to 6.4.2.4 and

to add section "6.5.1.1 One sign of one or two sides no larger than 30 sq. ft. (3.2 sq. m) per side. No electric signs of any type will be permitted except those illuminated by stationary floodlight." and

to add section "6.5.1.2 No outside display of merchandise shall be permitted except agricultural and horticultural products." and

to add section "6.5.1.3 Post Office." and

to add section "6.5.2.1 Hotel, restaurant with or without liquor license provided no drive up or curbside food service shall be allowed."

VOTE: AYES - 79 NAYS 1

The motion was made and seconded to adjourn the meeting at 8:15 p.m., and so voted.
